General conditions of sale for products sold on www.euromi.com

  1. Ordering conditions

The consumer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization as an emancipated minor and not to be protected within the meaning of article 488 of the Civil Code allowing him to perform an order on the site.

Online ordering of certain products (liposuction and lipofilling devices, breast implants, mesotherapy gun, abdominal belts, clothing for severe burns and SED) is impossible thanks to computer setting rules.

Some products are only available for sale to healthcare professionals (liposuction devices, lipofilling, breast implants, mesotherapy guns). For these products, a form allows to contact a sales representator.

These General Conditions of Sale are contractual. They determine the rights and obligations of the parties on the day of the order, in the context of the online sale of products offered by the company EUROMI.

EUROMI reserves the right to modify these at any time. However, the GTCs applicable to the order are those accepted by the customer at the time of placing the order.

 

  1. Prices and payment methods

The applicable prices are the prices effective when the order is placed.

The prices displayed on the site are indicated in euros.

The prices of articles reserved only for Belgium are mentioned including VAT. The prices of items accessible both in Belgium and in the rest of the world are shown excluding VAT; VAT is then added or not depending on the country of destination of the order.

Euromi offers you an online payment method by bank debit cards or by credit cards via an ultra-secure payment system (Mollie).

  1. Availability

In the event that a product is unavailable within the time limits indicated, Euromi reserves the right to offer the consumer a replacement item of quality and an equivalent price. If the item is not available directly in stock, EUROMI will communicate the delivery delay. In the event that Euromi cannot provide an article of equivalent quality and price or if the consumer does not wish this article of equivalent quality and price, the consumer may cancel his order.

 

  1. Delivery

An order is final once the good has been shipped, handed over to the carrier.

For more information in this regard, we refer to Article 7 which establishes the right of withdrawal.

The billing country must correspond to the country where the order will be delivered.

All deliveries are made via a private carrier ensuring traceability of each shipment until delivery.

 

  1. Order refusal

Euromi reserves the right to refuse any order placed online. Euromi is under no obligation to justify such a refusal. If Euromi decides not to fulfill an order placed online, it immediately informs the consumer.

Orders can only be validly placed via the Euromi e-commerce platform in one of the following languages: French, English.

 

  1. Protection des données personnelles

All personal data that is necessary to process an order is intended for EUROMI SA.

EUROMI SA undertakes to respect the confidentiality of this personal data and to treat it in accordance with the law relating to the protection of privacy with regard to the processing of personal data.

In application of the law relating to the protection of privacy with regard to the processing of personal data, the buyer has the right to access, modify, delete and rectify personal data concerning him and kept by EUROMI SA.

The buyer may exercise the aforementioned rights by sending his request by email to the address: internet@euromi.com or by post to the following address: Euromi sa – ZI des Plenesses – 11, Rue des nouvelles technologies – B -4821 Andrimont (Belgium).

Euromi will use this data to process the buyer’s order, as well as to strengthen and personalize communication, including through newsletters / emails.

Euromi may also use this data to personalize its Website according to the preferences observed by buyers.

These data will be stored securely by Euromi, and may be transmitted to Euromi’s partners, for the purposes of processing the order only.

Euromi reserves the right to have the personal data you communicate to us analyzed.

Euromi uses the services of a banking institution accredited to the NBB for payments. This establishment complies with all security standards applicable to online payment and uses encrypted language.

Euromi does not keep any bank loans and communicates with the banking institution only with a reference number.

 

  1. Waiver of purchase – Right of withdrawal

An order is final once the good has been shipped, handed over to the carrier.

The consumer has the right to notify Euromi that he / she renounces the purchase, without penalty and without giving any reason, within fourteen calendar days from the day after the day of delivery of the goods.

Confirmation of your cancellation will be sent to you by return email.

If the buyer has validly exercised his right of withdrawal in writing within 14 calendar days, he will be refunded the amount of the value of the goods purchased.

Any waiver of purchase entails the buyer’s commitment to definitively and irrevocably renounce the use of the good.

The goods must be returned directly to Euromi, at the expense of the buyer. Please note that the products must not be damaged, used and always in their original packaging.

The buyer will be reimbursed no later than thirty days from the date of receipt of the returned product to Euromi. The buyer will be refunded the amount he paid into the bank account linked to the card used for payment.

Administrative and banking costs incurred will be deducted from the amount of the purchases.

 

  1. Retention of title

The delivered goods will remain the property of Euromi until they are handed over to the carrier, once the consumer has paid the price.

 

  1. Settlement of disputes, applicable law and competent jurisdiction

Any complaint must be sent to the e-commerce customer service at the following address: internet@euromi.com who will try to respond as quickly as possible.

9.2 Applicable law and competent jurisdiction

These general conditions of sale are subject to Belgian law and to the Vienna Convention on contracts for the international sale of goods. All disputes relating to the commercial relationship between the consumer and Euromi are subject to the jurisdiction of the courts of the city of Verviers (Belgium).
